Welcome to comeupz.com ("we", "our", or "us").

By accessing or using our website and services, you agree to comply with and be bound by the following Terms and Conditions.  If you do not agree to these terms and conditions, please do not use our services.

1. Overview of Services

Comeupz.com is a resale platform that helps users sell their unwanted items.  We post and promote items for sale at discounted prices and take a commission on successful sales.

2. User Eligibility 

By using our services, you represent that you are at least 18 years old and capable of entering into a binding contract.  If you are using the site on behalf of a business or other entity, you confirm that you have the authority to bind that entity to these Terms. 

3. Item Submission & Ownership

• Users must have full ownership and legal rights to any item they submit for resale on Comeupz.com.

• By submitting an item and or Photo an item, you grant us the right to edit, list, promote and sell the item on your behalf.

• Items deemed inappropriate, illegal, hazardous, or counterfeit will be rejected and may be reported.

4.  Pricing and Commission

• Comeupz.com reserves the right to suggest or set final pricing for any item, based on market value, demand, and condition.
• A commission fee will be deducted from the final sale price.  Commission rates will be disclosed and must be agreed by both parties before item listing.
• Payouts to sellers will be made after item has been successfully sold and delivered to the buyer.

5.  Condition of Items

All items must be in good, sellable condition.  By submitting a photo,      you confirm that:

•  It is clean, functional and accurately as described and portrayed in the photo submitted.
• Any defects or wear and tear are disclosed.

We reserve the right to return or dispose of items that do not meet our standards.

6.  Shipping & Delivery

Comeupz.com handles logistics for listed items.  Sellers may be required to drop off items or arrange pickup based on our process.  Buyers are responsible for providing accurate delivery information.

7.  Refunds & Returns 

All sales are final unless the item is significantly not as described or arrives damaged.  Comeupz.com will review disputes on a case-by-case basis.

8. User Conduct

Users agree not to:

• Submit stolen, fraudulent, or illegal items.
• Misrepresent ownership or condition of items.
• Harass, threaten or abuse staff or any other users.
• Use our platform for unauthorized commercial activities. 

9. Intellectual Property

All content on Comeupz.com (text, images, branding) is the property of Comeupz.com and may not be reproduced without permission.

10.  Limitation of Liability

Comeupz.com is not liable for:

• Items lost or damaged in transit (unless due to our negligence).
• Losses from misrepresented items or failed deliveries caused by third-party carriers. 
• Indirect or consequential damages. 

11. Changes to Terms

We reserve the right to update these Terms at any time.  Continued use of the website after changes implies acceptance of the revised terms. 

12. These Terms are governed by the laws of California.  Any disputes will be resolved in the appropriate courts of that jurisdiction.
